Texas Penal Code, § 49.045. Driving While Intoxicated With Child Passenger
(a) A person commits an offense if:
(1) the person is intoxicated while operating a motor vehicle in a public place; and
(2) the vehicle being operated by the person is occupied by a passenger who is younger than 15 years of age.
(b) An offense under this section is a state jail felony.
A DWI with a child in the vehicle charge can be attached to any DWI even if your blood alcohol content is under the legal limit of 0.08 grams. If the arresting officer determines that a driver is unsafe to operate a vehicle due to the use of alcohol or any drug, the driver can be charged with DWI and subsequently DWI with a child passenger. Offenses involving the endangerment of children could result in an investigation by the Child Protective Services that could have a negative effect on the driver’s parental rights.
